Terms of service

What this is

Abracade is a small, curated catalog of games for iOS, made by aitaco LLC ("we", "us"). You buy tokens through Apple's In-App Purchase system; games cost tokens to play. By creating an account or using the app or this website, you agree to these terms. If you don't agree, don't use them. You must be at least 13 years old.

Your account

You sign in with Apple, which lets your token balance follow you across devices. Your account is yours alone — don't share it, and don't use someone else's. You're responsible for what happens under your account, so tell us if you think it's been compromised.

Tokens

Tokens are how you pay to play. The important things to know, plainly:

The games

The catalog is deliberately small and it will change: games get updated, rebalanced, added, and sometimes removed. We'll aim to keep this fair — reasonable notice when a game is leaving, and your tokens intact — but we can't promise any particular game will be available forever.

Your license, and its limits

We grant you a personal, non-exclusive, non-transferable license to use the app and play the games. That license doesn't include: reverse-engineering or copying the app, the gargantua engine, or the rebrand AI stack; cheating, exploiting bugs, or manipulating scores or token balances; automating play with bots or scripts; or reselling or redistributing any of it. The Abracade name and mark, the apps, the engine, and the games are the property of aitaco LLC.

Telemetry

The app collects gameplay telemetry — events, sessions, crashes — to run the service and improve the games. What's collected, why, and what never leaves your device is spelled out in the privacy policy, which is part of these terms.

What we promise, and what we don't

We work hard to make Abracade good, but it's provided "as is" and "as available" — we can't guarantee it will always work, always be available, or always be bug-free, and we make no warranties beyond what the law won't let us disclaim. If something goes wrong and we're liable, our total liability is capped at the amount you paid us in the 12 months before the claim. We're not liable for indirect, incidental, or consequential damages. Some places don't allow these limits, so they may not fully apply to you.

Termination

You can stop using Abracade and delete your account in the app at any time. We can suspend or close accounts that break these terms — cheating, fraud, abuse of the service or of other people. If we close your account for abuse, forfeited tokens are not refunded. If we close it for any other reason, we'll handle your balance fairly and in line with Apple's policies.

Apple's terms

The app is distributed through the App Store, so Apple's standard Licensed Application End User License Agreement also applies, and fills any gaps these terms don't cover. Apple has no obligation to provide support or maintenance for the app and isn't responsible for it — we are. Apple and its subsidiaries may enforce these terms as a third-party beneficiary.

If we have a dispute

Talk to us first — email chef@aitaco.co and we'll try in good faith to sort it out within 30 days before either of us files anything. If that fails, these terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules, and any dispute goes to the state or federal courts located in Denver, Colorado.

Changes to these terms

We'll revise these terms as the product grows. Material changes get a new effective date at the top of this page and notice in the app before they take effect. Using Abracade after a change means you accept it.
